The six were in 2013 accused of killing the billionaire by putting poison in his drink while at a club in Thika.
According to Justice Korir, the prosecution, through submitted evidence and testimonials, had proven beyond reasonable doubt that the six were guilty of the charges.
The court further proved that the first, second, third and fourth respondents sat with the deceased on the material day. It was confirmed that they never left the table till the end of the night.
According to Justice Korir, the four accused had the means and opportunity to tamper with the drink. “It is my finding that the prosecution has proved its case. Each accused is convicted accordingly,” the judge noted.
Cancelling their bail, the court dismissed testimony submitted by the sixth accused, who claimed she had bought a drink for the victim.
“Was the hug of the sixth person the Judas kiss? Evidence showed that she was a regular customer and she would be given the change even without buying a drink for the MP,” the court noted in reply to her testimony that stated she hugged the former legislator before leaving.
The judgment follows testimonials from 30 witnesses and adduced ten exhibits. Thuo died on the night of November 17, 2013, after a night out at a restaurant in Thika town in what was believed to be poisoning.
“His death was due to haemorrhagic gastroenteritis acute due to suspected chemical poisoning,” a pathologist had then noted.
