The appeal is against the Independent National Electoral Commission (INEC), the Peoples Democratic Party (PDP), and Governor Siminalayi Fubara.

One of Tonye-Cole’s key arguments is that Fubara did not resign as the Accountant General of the state within the constitutionally stipulated deadline and the Electoral Act.

Consequently, Tonye-Cole asserts that Fubara was not qualified to participate in the election, let alone be declared the winner by INEC.
