The case was brought by former Nigerian Vice President, Atiku Abubakar, who is challenging Tinubu’s eligibility to run for president in the 2023 election. Atiku claims that Tinubu did not obtain a valid degree from CSU, as he claimed in his nomination form.

The US court on Friday in a notification of docket entry stated that it has received “extensive email communications” from many third parties in relation to the case, but it will not consider them. The court said it will only review the official records on the docket and the parties’ briefing.

“The court understands the significant public interest in this dispute, but the court will not consider any third-party or ex-parte submissions. Rather, the court’s review will be limited to the parties’ briefing and the official records on the docket,” the court notification said.

Sahara Reporters had reported earlier that Atiku filed a fresh motion urging the US court to overrule Tinubu’s request to stop CSU from releasing his academic record. Tinubu had filed a motion to quash the subpoena issued by the court to CSU, arguing that it violated his privacy rights and that Atiku had no standing to sue him in a US court.

Atiku, however, argued that Tinubu had waived his privacy rights by publicly disclosing his CSU degree and that he had a valid cause of action against him under the Nigerian Constitution and Electoral Act. Atiku also claimed that Tinubu had failed to exhaust all available remedies in Nigeria before seeking relief in the US.
