This is because the judicial process has been fervent about the way the case is proceeding.

However, the counsel for the defendant in the case, Mr. Kunle Adegoke SAN, proclaimed the nature of the sickness that his client, Dr. Adedoyin Rahman, is battling and demanded permission for the defendant to go and get proper health care so that his state of health would not deteriorate beyond expectations.

It is on this basis that Justice Inyang Ekwo of the federal high court, situated in Abuja, ordered the Inspector General of Police, Usman Baba, to grant the detained proprietor of Hilton Hotel access to visit any hospital of his choice pending the hearing and determination of the fundamental human rights suit.

Therefore, the judge adjourned the case till January 21, 2022.

However, it is a fact that numerous Nigerians who had been following the case were indignant about hearing about the situation on the ground.

This is because there is a misconstruing of the information that the people heard about the case, as many had reckoned that the judge had indirectly granted bail to the defendant, and that had led to various reactions from Nigerians on several social media platforms.

What Does Nigerian Law Say About An Accused Who Is Sick During Litigation?

Nigerian law does not restrict an accused from accessing proper medication during his or her prosecution. The law says such a defendant is liable to receive proper medication till he or she is pronounced sound so that he or she can continue his or her prosecution.

Thus, the judge who granted the defendant permission to access health care is still within the law and has never acted contrary to the law of Nigeria.

Therefore, the permission he granted is just for the defendant to access health care, which he has the right to, which doesn’t represent the bail.

Hence, people should not be confused as the case must proceed and right justice will still be served. That is why the judge adjourned the case till January 21, 2022.
