Winnie Maina had argued that they were so drunk that she couldn’t recall what exactly happened.

Maina is accused of inflicting injuries on her 33-year-old husband, Wycliffe Mirit in August 2022.

Marit later succumbed to stab wounds while undergoing treatment at the Moi Teaching and Referral Hospital in Eldoret.

Justice Reuben Nyakundi however ruled that all evidence produced by the prosecution proved it was murder.

Maina had argued in her defense that her husband armed himself with a knife and attacked her after they returned home from a late night drinking spree.

During the fight, the deceased sustained stabs in his chest and died moments later.

“You armed yourself with a knife and targeted your husband at the most lethal spot where his survival chance was zero,” Nyakundi said.

“It’s not possible that you may have acted out of provocation or self-defense because you could have targeted any other part of the body if you intended to stop him,” the judge said.

He said evidence proved that Maina wanted her husband dead and that is why she stabbed him in the chest.

“All facts also point to you having malice aforethought in your actions and hence I find you guilty of murder,” Nyakundi noted.

Maina, who has been out on a Sh2 million bond broke down as the judge cancelled her bond and put her in custody to await her sentencing for the offense of murder.

Her father and younger sister who had travelled with her from Murang’a for the ruling were equally shocked with the ruling.

“Dad today you will not return with your daughter home because the court has found her guilty, and we will now have her in custody as we process the sentencing”, said Nyakundi.

The judge allowed Maina’s father time to talk to her daughter before she was whisked away to the Eldoret GK prison.

“I know for you as a father it is a difficult moment but it shall be well. It shall be well,” Nyakundi said.

He cautioned that domestic violence should not be an excuse for anyone to murder a partner.

“Even the Bible does not allow that at all. There is the option of returning to the sender if you are tired of each other. Let him or her go back home instead of killing,” Nyakundi said.

The judge ordered for the pre-sentencing probation report and a victim’s report before June 3 when Maina will know her fate.

She had denied killing Miriti who was a Senior Logistics Officer at an international Beverage Company based in Eldoret.

The incident happened at their Elgon View Estate residence in Uasin Gishu County.

According to the police report, the woman had rushed her husband who was in critical condition to the hospital in the family car but he succumbed to three knife stabs upon arrival at the hospital.

A security guard at the lavish Elgon View estate where the couple lived had told detectives that the duo arrived at their house from a local pub at around 4.30 am on the fateful Monday, August 22 before a fight erupted between the duo.

The guard, Geoffrey Rono who is attached to a local security company, reported the incident to the Langas Police Station..CONTINUE READING>>
