A man in Kakamega found himself in trouble after he failed to pay KSh 40 for bananas he had eaten. Wellington Pera was arrested not only for failing to pay for the fruits she had eaten but also for attacking the vendor who was demanding her dues.

According to a police report, Pera allegedly assaulted the vendor, who demanded to be paid KSh 40 for the bananas the former had consumed.

The accused was presented to Kakamega Chief Magistrate Julius Ngarngar for his actions. Interestingly, a previously defiant Pera was remorseful for his actions when he was produced before the magistrate to answer to assault charges.

He was accused of committing the offence in Ichina village, Kakamega County, on Friday, March 29. Section 251 of the Penal Code provides that anyone who commits an assault and causes bodily harm is guilty of a misdemeanour and liable to a jail term of up to five years.

Appearing before the magistrate, Pera acknowledged that he ate Maureen Ayuma’s bananas worth KSh 40 and refused to pay.

He pleaded for leniency and asked the court not to sentence him to a custodial jail term and that he would strive to be a good citizen.

The prosecutor explained to the court that Ayuma was headed to the market to sell the bananas when she met Pera, who asked for four bananas worth KSh 40.

After the incident, Ayuma reported the matter at a police station in Kakamega and filled out the medical P3 form, after which the accused was arrested.

It was a humbling moment when Pera pleaded with the court to have mercy on him in a gentle voice and with an innocent countenance. He said it was the first time he was getting charged in court.

The court considered his plea and ordered the prosecution to produce a probation report about Pera. Ngarngar directed that the probation report be produced in court on Tuesday, April 16, when the case will be mentioned for further directions.

According to the magistrate, the probation report would determine if the accused person met the threshold for a non-custodial sentence that he was appealing for.

In 2023, a man was charged with beating up a tea and mandazi vendor after refusing to pay for the food he had bought from him.
