Justice Grace Nzioka sentenced Jowie to death after convicting him of the murder of businesswoman Monica Kimani.

The court indicated that the prosecution had proven beyond a reasonable doubt that Jowie committed the offence. During the judgment, Justice Nzioka said that the prosecution had convincingly placed the accused at the crime scene.

Barely two days after the sentencing that ignited mixed reactions, Jowie filed a notice of appeal on Friday, March 15.

His new lawyer, Andrew Muge, filed the notice of appeal and will represent him in the subsequent proceedings.

Ahead of his sentencing on Friday, March 8, Jowie had notified the court that he wanted to change his advocate. Prof. Hassan Nandwa represented him in the concluded matter.

In the appeal notice, Muge indicated that his client would be appealing against the murder judgment and the death sentence.

Muge reiterated that Jowie was interested in physically attending the appeal hearing.

After the sentencing, Muge expressed his dissatisfaction with the judgment and sentencing, saying that the court had created a mountain out of a pair of brown shorts.

According to him, the prosecution failed to provide exculpatory evidence by refusing to present pictures that showed Jowie in different shorts.

Muge said the photographs taken at Maribe’s house when investigators collected evidence showed Irungu wearing brown Khaki shorts with side pockets, but the one produced in court differed.

Exculpatory evidence is evidence favourable to the defendant in a criminal trial that exonerates or tends to exonerate the defendant of guilt. It is the opposite of inculpatory evidence, which tends to present guilt.

High Court Judge Grace Nzioka, who sentenced Jowie to death, later explained that there was a difference between the sentence and life in prison.

Jowie has formally notified the court that he will be appealing against the judgment of Justice Nzioka.
