The case had been scheduled for hearing before Milimani Senior Principal Magistrate Wandia Nyamu, but it could not proceed since Loitiptip was not present in court prompting a senior state prosecutor to apply for an arrest warrant.

The magistrate granted the application and issued the arrest warrant against Loitiptip. The case will be mentioned on October 14, for further directions.

In the first count, Loitiptip is accused that on August 3, 2022, at an unknown place within the country, without lawful authority or excuse made a motor vehicle registration certificate purporting it to be a genuine certificate issued by the National Transport and Safety Authority (NTSA).

He faces another count of fraudulently uttering to Samson Malonza a forged motor vehicle certificate for motor vehicle registration number KDA 005C on the same dates and place.

Loitiptip is also accused of fraudulently obtaining from Samson Malonza a total sum of Sh6 million by falsely pretending that he was in a position to sell to him a Landcruiser V8.

He is alleged to have committed the offence on August 3, 2022, in the Kileleshwa area in Kilimani, Nairobi county.

Anwar said the complainant was his good friend and had an agreement.

Police records indicate that Loititip approached the complainant and offered to sell him the vehicle. After Malonza paid the amount, Loititip refused to transfer the car to him and began taking him in circles, making him suspect he had been defrauded. The former senator faced a second count of forging a motor vehicle registration certificate.

“I come from Lamu, and I am in a financial crisis. Honestly, I am facing bankruptcy. I am a legislator and civil servant and the complainant is my good friend, I am willing to transfer the logbook or refund the money,” he said as he pleaded for lenient bail terms.
