The High Court has given the Ethics and Anti-Corruption Commission (EACC) a nod to seize property worth Ksh198 million believed to be proceeds of corruption.....CLICK HERE TO READ THE FULL ARTICLE>>>

In a ruling dated August 12 contained in last week’s Friday’s Kenya Gazette Notice where the EACC was the plaintiff, the High Court granted EACC the right to recover property including real estate property and money in the bank from eight respondents.

The Court decreed Ksh22 million as being cost of the parcel to be paid to EACC by the defendants within 30 days from the date of entry of the judgment, which was on August 1.

Further, the court ordered Ksh176 million being costs of developments of the Hydeout Riviera Hotel, to be paid to the Commission by the defendants within 12 months from the date of the judgment.

“The Hydeout Riviera Hotel, measuring approximately 0.19 Ha be hived off from Parcel Number Kisumu/Reru/1453 and the Plaintiff be at liberty to execute and the decretal sum to accrue interest at 12% per annum,” clarified the order in case of a default.

The court also forfeited Ksh799,000 cash seized from the defendants to the plaintiff.

“Pending the hearing and determination of this application inter parties, a temporary injunction is issued restraining the defendants/respondents by themselves, their servants, agents or any other person from transferring, and/or disposing of, howsoever described,” read the order in part.

Among parcels of lands that were forfeited to the EACC were located in Siaya, Kisumu and Utawala Estates among others.

The order by the court is a boost to the commission in recovering property attained through corruption. According to EACC, the value recovered by the commission in the form of unexplained wealth held by public officers and corruptly acquired assets has significantly increased to Ksh28 billion in 2023 from Ksh3.6 billion in 2018.

This comes after over 300 cases of fake detectives impersonating EACC officers or other law enforcement agencies on official duty were reported this year.

In July 2024, EACC arrested a police officer attached to Muthangari Police Station and four other imposters who were caught raiding a Kitui County Official’s home.
