Justice James Rika of the Employment and Labour Relations Court in Nairobi issued the orders on Tuesday.

He certified the petition by the Teachers Service Commission as urgent.

The Kenya Union of Post-Primary Education Teachers is listed as the respondent, with the Ministry of Labour and Social Protection as an interested party.

“Pending hearing and determination of the application inter parties, an order of temporary injunction is granted to the petitioner, restraining the respondent, its officials, members and employees from withdrawing labour or participating in industrial action,” Justice Rika said

The matter will be mentioned on September 5.

Tutors who are members of the Kenya Union Post Primary Education Teachers began their strike on Monday, August 26, demanding among others, the implementation of their collective bargaining agreement with their employer, the Teachers Service Commission.

Kuppet had earlier maintained that its members will down tools until the CBA is implemented.
