The Acting Inspector General of Police Gilbert Masengeli appears to be backtracking when he now claims that security officers attached to Justice Lawrence Mugambi were recalled for further training.

There had been widespread reports that Mugambi’s security was withdrawn after he ruled that Masengeli should go to jail if he did not honour a court summons this week to explain the fate of three activists allegedly abducted by the police.

The executive has repeatedly complained about an activist judiciary impeding its work. Masengeli sent the Deputy IG to represent him and the police in court but this did not satisfy the judge who wanted the IG to apppear in person.

Whether or not this demand was excessive, Masengeli should have attended court. The Police IG is not above the law.

At best, it was insensitive to send Mugambi’s security for further training after he was sentenced to jail. At worst, it was a petty and vindictive reaction to the judge’s ruling.

All of Kenya is concerned that activists have been disappearing, often allegedly abducted by plainclothes police. Masengeli does not just owe the court an explanation, he owes the nation an explanation.
