The CS in response to a case challenging his appointment has denied the allegations levelled against him saying they remain unsubstantiated.

“The issue of drug trafficking is bare, unsubstantiated and is so generalized that it is not possible for any party to adequately respond to the same,” Joho stated.

“It is therefore denied and the petitioner is invited to prove the same.”

Genesis for Human Rights Commission filed the case in court claiming Joho was illegally appointed into office.

It sought orders to have his appointment revoked and a fresh process commenced.

The commission in its petition claimed that the Committee on Appointments disregarded several memorandums allegedly containing evidence of Joho’s unsuitability for appointment.

The commission through its boss Caleb Ngwena claimed Joho lacked the requisite academic qualifications to hold office and also his alleged deals on drug trafficking as per the dossier tabled in Parliament by the late George Saitoti.

Ngwena also raised the issue of alleged economic crimes.

The CS took over from his predecessor Salim Mvurya on August 9 after taking oath of office in a ceremony presided over by President William Ruto.

Joho has asked the court to dismiss the case filed by the human rights group.

Through his Advocate Paul Buti, Joho stated that the courts had already determined the issue of his academic qualifications and certificates.

The CS said he is suitable to hold office and has at the same time challenged his accuser to provide evidence that will support his claim that Chapter 6 of the Constitution which deals with Integrity issues has been violated.

“Nothing unconstitutional has been pointed out by the petitioner to persuade the court to grant orders sought. This matter should be dismissed,” he said.
