Charles Mugane, who identifies as an advocate and human rights defender, seeks the order arguing that Masengeli violated Chapter 6 of the Constitution and the Leadership and Integrity Act.

“Anytime served in office by Masengeli after his conviction is nothing but a gross mutilation and dismemberment of the very constitution that we so much pride in and in whose defence he swore to uphold,” Mugane said.

He has asked the court to issue an order stopping Masengeli from acting, serving and performing duties of the IG or Deputy IG of the National Police Service (NPS)

Mugane has based his application on the IG’s recent conviction and sentencing over contempt of court proceedings.
