The Adani Group subsidiary sought to lease JKIA and modernise its facilities for the next 30 years. Appearing before the Senate Committee on Transport on Monday, September 23, Treasury Cabinet Secretary (CS) John Mbadi confirmed that the deal was yet to be signed.

Mbadi noted that the Public Private Partnership (PPP) committee halted the deal’s due diligence exercise until the matter in court was settled. “The PPP directorate has not approved any stage of the Adani Airport Holdings deal without the approval of the PPP committee, which stopped carrying ou due diligence following the matter in court,” said Mbadi.

Mbadi told the Kiambu Senator Karungo Thangwa-led committee that should the court uphold the deal, the Indian firm will not get clearance from the PPP committee until it meets some conditions.

“We cannot approve the project development agreement for JKIA until Adani Airport Holdings meets the conditions,” he noted.

The CS highlighted some of the conditions set by the PPP committee as follows:

  1. Ensure all airport workers are onboarded on better terms
  2. Ensure the firm prioritises Kenyans during recruitment
  3. Incorporate Kenyans’ views obtained through public participation
  4. Ensure no changes to the deal terms without engaging the PPP committee
  5. Ensure clear provisions for open book accounting for full disclosure of the project account
  6. Identify, allocate and ensure appropriate mitigation of all risks
  7. Clearly define the project mandate
  8. Ensure due process in changing airport service charges
  9. Ensure cargo business is well defined in the concession

High Court announced a new date for the proceeding of the case, which blocks the implementation of the JKIA-Adani lease deal, has been pushed to October 17.
