Justice Grace Nzioka ruled out rehabilitation, reconciliation and compensation as sentencing options in Jowie’s case
The prosecution and the defence agreed that Monica Kimani was killed in a brutal and horrifying manner.
The High Court of Kenya has sentenced Joseph Irungu, alias Jowie, to death after convicting him of the murder of businesswoman Monica Kimani.
Kimani was found brutally murdered in her Nairobi apartment on September 20, 2018, and Jowie and his ex-lover Jacque Maribe were arrested as prime suspects.
During the Friday, February 9, judgment, Justice Nzioka acquitted Maribe of the murder charges, found Jowie guilty, and proceeded to write a sentence, which she delivered on Wednesday, March 13.
The judge indicated the importance of the sentencing part of any trial, reiterating that she had looked into the evidence adduced during the trial and weighed it according to the law to ascertain the most appropriate and proportionate sentence.
One thing that was agreeable between the prosecution and the defence was that Kimani’s murder was brutal and horrifying.
The judge dwelt on the manner in which the killing was planned and executed and ruled out rehabilitation, compensation, and reconciliation as possible options for her sentencing.
The postmortem report indicated that Kimani’s neck was cut with a sharp force, which showed that the assailant did not allow her any chance of survival.
Gory images of the murder scene were not something one would want to look at again and were traumatising to the family, as paraphrased by Justice Nzioka.
She cited evidence that proved the convict intricately planned and used his expert tactics to kill Kimani and also referred to the Bible, reiterating that there was no justification for taking away anyone’s life.
In reference to the Bible, the book of Job 1:12, Nzioka demonstrated how life was sacred and even God himself could not allow the enemy to take it away from his faithful servant Job.
The reference was to reiterate why no one was justified in taking away another person’s life and that only God has such powers.
