This situation has arisen due to a conflict with her US-based son Abel Haroya Nyaruri over the ownership of a property that was meant to be a testament to her children’s success and affection.

The origins of this dispute trace back to the early 2000s when Esther’s children, who had established themselves in the United States, collectively purchased land and constructed a home for their parents.

This act of filial devotion resulted in Esther and her husband Jason Nyaruri moving from the Rhonda slums to the more upscale Ngata area. The family’s joy seemed complete when Esther visited her children in the US in 2005, followed by Jason in 2009, while their daughter Beatrice remained in Kenya to manage the family property.

However, the family’s harmony was shattered in 2016 when Abel, the youngest son, visited Kenya and persuaded Beatrice to relinquish the land’s title deed, ostensibly for administrative purposes. Unbeknownst to the family, Abel subsequently transferred the property title to his name without their knowledge or consent.

The gravity of this action became apparent in 2020 when Beatrice discovered she was barred from accessing her parents’ home by an employee of Abel’s. This revelation precipitated a legal battle with Jason Nyaruri initiating proceedings in the Environment and Lands Court.

On November 18, 2020, the court ruled that the parents and their other children could reside in the main house while Abel could utilize the farm. However, Abel defied this court order, bringing acquaintances to occupy the building and subjecting his family to physical and verbal abuse.

The family’s subsequent filing of a contempt of court case resulted in Abel being imprisoned and fined twice, though he was released after paying fines totalling Sh800,000. Rongai Sub-County Police Commander Wilberforce Sicharani has criticized the Office of the Director of Public Prosecutions (ODPP) for delays in addressing files related to Abel.

According to Sicharani, the ODPP had requested to review at least three files concerning Abel but had not provided feedback. In a response dated April 30, 2024, the ODPP instructed the police to apprehend and charge Abel with malicious destruction of property.
