Deputy CEO Abdi Mohamud represented the Commission before the Senate where he briefed the senators on the law of gifts given to members of the public and state officers.
Responding to Tana River Senator Danson Mungatanaโs concern about gifts and cows reportedly given to Gachagua, the EACC official explained that gifts with a value of more than Ksh20,000 are supposed to be handed in and declared by all public and state officers.
Further, he clarified that the Commission has not investigated the existence of the material cows that are involved in the issue.
โIf indeed cows have been donated to any public officer, those donations are supposed to be donated to the state. In addition, the officer within 48 hours is supposed to hand in those donations to the institution that employs them,โ Mohamud said.
At the same time, the Commissionโs Deputy CEO proceeded to clarify why EACC never showed up in the National Assemblyโs consideration of DP Gachaguaโs impeachment.
In his submission, Mahmud said that the commission was not invited to attend the sessions at the National Assembly.
The official was also called upon to clarify when the companies involved in the procurement irregularities received their documents.
Mohamed answered noting that he is not sure of the exact dates when the documents were issued.
โIn this particular case, Shobika was the special company that we were looking at and that was the reason why it was identified,โ he explained.
He further asserted that the bid document had challenges as the commission indicated in its evidence.
On the tabled irregularities, Kibwezi Member of Parliament Mwengi Mutuse had included bullying of Kenya Medical Supplies Authority (KEMSA) officials as one of the 11 allegations against Deputy President Rigathi Gachagua.
