He contended that the resolution passed by the National Assembly was invalid for several reasons and that the impeachment motion contained general, unsupported allegations.

On Tuesday, October 15, Milimani Law Court presiding Judge Chacha Mwita declined to grant Gachaguaโ€™s request, allowing the Senate to proceed with the impeachment process.

Justice Mwita ruled that the constitution grants Parliament the authority to handle the impeachment process, stating that the court should refrain from interfering.

He emphasised that Gachagua could challenge the Senate’s final decision if he felt aggrieved. The court’s decision has sparked mixed reactions among Kenyans.

Gabby Gabriel Clement said: “It’s all systems go. Siku ya nyani kufa miti yote huteleza. The … must be removed from office latest 8:30pm on Thursday.”

Keziah Gichuki wrote: “I pity Kenyans, most of your comments sound tribal..how is this impeachment improving our economy? What about Adani and the high taxation that has made many businesses close? What about our health sectors? Instead of addressing these issues on these platforms, most of you are very happy about the impeachment, what will benefit you as an ordinary mwananchi? This man whether impeached or not has enough to feed his family whether looted or from hard work…we should now be focusing on issues that is touching our lives on these platforms. Many leaders are after their stomachs not for your interests.”

Nderitu M Simon advised: “It would be wise for him to resign, as the Senate is already compromised.”

Bedaya Towet-Journalist observed: “The court has given reasonable reasons. It has termed the parliament proceedings as a political process and that the court can only come in if the constitution is violated. They have also said the parliament is an equal arm of government just as the judiciary.”

Maiko Nau said: “I said it… Gachagua should just resign…this impeachment was well calculated from the bottom-up.”

Chore Obenge remarked: “Courts cannot stop parliamentary proceedings even Kingi said. His legal team misadvising the truthful man.”

Victor Kipkosgei Kipruto argued: “When the system wants you out, no matter how hard you try, you cannot outsmart the system.”

Ten Ten Flavour claimed: “The advisors to Gachagua are the ones messing him, walimdanganya akaitisha press kumbe wanapea parliament evidence, wamesonga kortini wakati senate bado, so after judge kutupilia senate wanajua ata court haimtaki, it will be easy for senate now to confirm.”

Meanwhile, the National Assemblyย  presented two evidence pickups ahead of the Senate trial, which is set to begin on Wednesday, October 16. This was after MPs impeached Gachagua on 11 grounds, including corruption and abuse of office.
