Activist Morara Kebaso’s Case Thrown Out, All Charges Against Him Dropped

“The statement of the charge preferred against the intended suspect does not disclose which section of the Cyber Misuse Act he is charged…I find the objection raised and the application made by the defense counsel merited.” ruled the Magistrate.

According to the court, the particulars of offence do not capture or outline the elements of the offence of cyber harassment as alleged by the prosecution.

The court further said that the prosecution failed to disclose and state in a clear and unambiguous manner for the intended suspect (Morara) to answer the charges.

The court also said that the prosecution failed to adhere to the principle of Law governing charge sheet by failing to disclose and state the offence they intended to charge Morara with in clear manner.
