Blow To Gachagua As Court Declines To Stop Planned Public Participation On His Impeachment Motion

However, on Thursday, October 3, High Court Judge Bahati Mwamuye declined to issue orders stopping the public participation exercise on the impeachment motion against Gachagua.

In his ruling, Justice Mwamuye certified the case as urgent and directed it to be heard as a priority.

“The petitioner/applicant shall serve the application, the petition and this court order on the respondents and the interested party by close of business today and shall thereafter file an affidavit of service in that regard by 10.00am of October 4.

“This application dated 02/10/2024 shall be mentioned on 09.10.2024 virtually to confirm compliance and take directions on the expedited hearing and determination of the matter,” Justice Mwamuye said.

What were Rigathi Gachagua’s prayers

According to documents filed in court, Gachagua’s legal team was seeking orders to stop the scheduled public participation exercise.

Gachagua also wanted a stay order against any proceeding on the proposed impeachment motion until the case is heard and determined.

“The petitioner seeks an ex parte order of stay against the public participation exercise schedule to commence on 04/10/2024 with respect to the impeachment motion.

Secondly, the petitioner/applicant is also seeking conservatory orders restraining the respondents from conducting or taking any further steps in the impeachment process with respect to the interested party, pending the hearing and determination of the petition,” the application readโ€ฆCLICK HERE TO READ MORE ARTICLES>>>
